Terms and Conditions for Rental of Reusable Moving Bin Boxes
1. Agreement Overview
These Terms and Conditions (“Agreement”) govern the rental of reusable moving bin boxes (“Bins”) provided by [123PACK] (“Company,” “we,” “us,” “our”) to the customer (“Customer,” “you,” “your”). By renting our Bins, you agree to comply with all the provisions outlined in this Agreement.
2. Rental Period
- The standard rental period is [number of days] days, beginning on the date the Bins are delivered to the Customer.
- Any extension beyond the standard rental period requires prior written consent from the Company and may be subject to additional charges.
3. Rental Fees and Payment
- The Customer agrees to pay the rental fee for the Bins as specified in the rental invoice.
- Payment is due upon delivery or before the delivery date, as outlined in the invoice.
- If the Bins are not returned on time, additional charges will apply as outlined in the invoice or as agreed in writing.
4. Delivery and Pickup
- Delivery of Bins to the Customer’s designated location will be made on the scheduled date.
- Pickup of the Bins will occur on the date agreed upon or after the rental period ends, unless an extension is granted.
- The Customer is responsible for providing access to the property for delivery and pickup.
5. Use and Care of Bins
- The Customer is responsible for the care and maintenance of the Bins during the rental period.
- Bins must be used for their intended purpose, which is for packing and storing goods during a move.
- The Customer must not use Bins for hazardous, perishable, or flammable materials or items that may damage the Bins.
6. Damage, Loss, or Theft
- The Customer is responsible for the Bins while in their possession and must ensure they are returned in the same condition as received, normal wear and tear excepted.
- If the Bins are damaged, lost, or stolen, the Customer will be charged for the repair or replacement cost.
- In the event of theft, the Customer agrees to report the incident to local authorities and provide a police report upon request.
7. Cleaning and Sanitization
- The Customer agrees to return the Bins in a clean condition.
- If the Bins are returned in an unsatisfactory condition, additional cleaning fees may apply.
8. Refund and Cancellations
- A full refund of the rental fee will be issued if the rental is canceled at least 14 days before the scheduled delivery date.
- Cancellations made less than 14 days before the scheduled delivery date may be subject to a cancellation fee
9. Liability
- The Company is not liable for any direct or indirect damages or losses arising from the use of the Bins.
- The Customer agrees to indemnify and hold the Company harmless from any liability, claims, or costs arising from the use of the Bins during the rental period.
10. Force Majeure
- The Company will not be held responsible for any delay or failure in delivery, pickup, or any other obligation under this Agreement caused by events beyond its control, including but not limited to natural disasters, strikes, or government restrictions.
11. Governing Law
- This Agreement is governed by and construed in accordance with the laws of Ontario Canada.
- Any disputes arising under this Agreement will be resolved through [mediation/arbitration] in Ontario.
12. Agreement Changes
- The Company reserves the right to modify or update these Terms and Conditions at any time. Any such changes will be communicated to the Customer prior to the next rental.
